General Terms and Conditions

1. Scope of Application These General Terms and Conditions apply to all services offered by West Coast Divers, including dive packages, diving courses, dive trips, and the rental of diving equipment.
2. Booking and Payment Conditions
   1. Diving courses and dive packages are personal and may not be shared or transferred to other participants.
   2. A booking becomes binding once a deposit of at least 10% of the regular price has been paid or PADI eLearning has been ordered. Without one of these actions, the reservation expires after two weeks.
   3. Any bank transfer fees incurred shall be borne by the customer.
   4. Payments can be made by bank transfer as well as on site in cash or by card.
3. Early Booking Discount An early booking discount is granted if the diving activity takes place at least 4 weeks in the future and the following conditions are met:
   • Diving courses:
     • The reservation request is made before June 1 of the current year.
     • PADI eLearning is purchased within 2 weeks after receipt of the offer.
   • Dives, trips, and try dives:
     • The reservation request is made before June 1 of the current year.
     • 50% of the early booking price is paid within 2 weeks after receipt of the offer.
4. Cancellation and Refund
   1. Sent theory materials such as PADI eLearning cannot be returned once activated. The amount paid will be credited against any applicable cancellation fees. The eLearning may also be used at any other PADI dive center.
   2. A full refund of the amount paid will be issued if participation in the booked service is not possible for valid, verifiable reasons, such as an accident or other unforeseen and compelling circumstances that make participation impossible.
   3. For all other cancellations, the following fees apply:
      • Up to 15 days before the start of the dive/course: 10% of the price
      • 7–14 days before the start of the dive/course: 20% of the price
      • 1–6 days before the start of the dive/course: 50% of the price
      • Less than 24 hours before the start of the dive/course: 100% of the price
   4. Cancellations within 24 hours before the start of the dive/course are only partially refundable if the booked service can be transferred to other participants. Otherwise, no refund will be granted.
   5. Rescheduling the service for a later date is possible but subject to the applicable fees. PADI eLearning may also be used at any other PADI dive center.
   6. Refunds will be processed within four weeks by bank transfer, minus any applicable transfer fees.
5. Cancellation and Illness on Site
   1. If a diving course or dive package cannot be completed on site for health reasons, an individual solution will be found (e.g. a voucher). Rescheduling for a later date is possible by arrangement.
   2. Trips, dives, and diving courses or course units that are canceled due to wind, weather conditions, or technical issues will be credited or refunded.
6. Participation Requirements
   1. Participation in diving activities requires the presentation of a valid diving certification (brevet). Exceptions apply to beginner courses.
   2. All participants must confirm their fitness to dive by completing a questionnaire. If required, a medical certificate must be provided.
   3. Divers are required to refresh their skills after extended periods without diving.
7. Insurance Requirement
   1. In Spain, diving without insurance is legally prohibited. Insurance can be arranged through West Coast Divers.
   2. Participants in beginner courses and try dives are automatically insured.
8. Safety Rules
   1. West Coast Divers reserves the right to exclude divers from further diving activities if they seriously violate safety rules or demonstrate insufficient diving skills that pose a risk to themselves or others.
   2. Compliance with general diving rules and staff instructions is mandatory. Failure to comply may result in exclusion from diving activities.
9. Rental of Diving Equipment
   1. The renter is liable for loss or damage to the equipment during the rental period and bears the costs in accordance with the dealer’s price list.
   2. Before use, the renter must check the equipment for proper condition and immediately report any defects to the dive center staff.
   3. The equipment must be returned in proper condition after use.
10. Liability
    1. West Coast Divers is only liable in cases of intent or gross negligence.
    2. Participation in diving activities is at the participant’s own risk.
    3. Participants are responsible for ensuring their fitness to dive and for following all safety instructions.
    4. The renter is liable for loss or damage to rented equipment in accordance with the dealer’s price list.
    5. Cancellations or changes to trip schedules due to weather conditions, technical issues, or force majeure do not give rise to any claims for compensation.
11. Jurisdiction and Applicable Law The law of the Kingdom of Spain shall apply. Place of jurisdiction is the location of West Coast Divers.
12. Data Protection West Coast Divers stores personal data in order to provide services and maintain customer contact. The data will not be passed on to third parties.
